Presentation of the certificate
L’Institut Des Usages (IDU) of the School of Law of Montpellier is creating a new certificate on Customary Law.
Intended for lawyers, students or practitioners, this training aims to understand the scope and the stakes of customary Law, to identify the opportunities and the legal regime of it.
Customary Law has a strategic place in modern Law. Initially developed in the field of international public Law, this Law is now developing particularly in private matters.
Indeed, the Law is not only not only a set of rules with court sanctions but also rules organizing human relationships.
This 100% online course represents 15 hours of classes given by professors from the School of Law of Montpellier Lise CHATAIN and Pierre MOUSSERON and from the Berkeley Law Laurent MAYALI.
Training objectives
- To remind that usages belong to Law, which drives us to the second objective…
- To offer a new and simple method of presentation of customary Law.
The program of the certificate
Facing most legal questions, it seems necessary to complement the classic legal analysis based on statutes and cases with a reference to usages. Ignoring them creates a worrying blind spot for the documentation. On the contrary, paying attention to customary Law opens a gold mine of arguments and improves the legal services on a national and even more at an international level.

Faculty Director, Comparative Legal Studies Program

In 1997 he was elected to a chair in Roman Christianity and sources of modern law at the Ecole Pratique des Hautes Etudes, at the Sorbonne in Paris. He has been a visiting law professor at several universities and has lectured extensively throughout Europe, Africa, and Asia in the areas of legal history and comparative law.
Laurent Mayali is the author and coauthor of many publications, including Droit savant et coutumes; “Symposium on Ancient Law, Economics & Society,” (with J. Lindgren and G. Miller) in the Chicago Kent Law Review; Rare Law Books and the Language of Catalogues, Universita degli Studi di Siena (with M. Ascheri); Customary Law Today (Ed. Laurent MAYALI and Pierre MOUSSERON, Springer 2018). He has also published numerous articles on medieval jurisprudence, customary law, and comparative law.

Co-director of the Master in International Trade Law – HEC
She has developed two lines of research: on the one hand, business tax law in connection with corporate law, and on the other hand, family tax law, in particular the understanding of the principle of gender equality through taxation.
He has published several books on Customary law including : “Les usages : l’autre Droit de l’Entreprise” (LexisNexis,2014); “Customary Law Today” (co-editor with L. Mayali, Springer 2018) and “Droit des usages” (IDU/LexisNexis 2021). Pierre Mousseron has been a Visiting Professor at the University of Florida (USA) and Sherbrooke (Canada).
How to register?
To register to the Certificate of Customary Law, it’s simple, you have to fill in a questionnaire by clicking on the button “Register now“.
This questionnaire permits us to examine your application (profile and motivations) in order to proceed to registration. Once we receive your application, we will get back to you within 48 hours.
Once registered, you will have access to the entire program on a dedicated platform from May 31, 2021.We will pay great attention to your registration and will listen to your motivations to join the program.
The deadline to apply is May 24, 2021.
How to obtain the certificate?

The certificate is based on a dissertation topic on a specific customary Law case.
The deadline for the dissertation is June 10, 2021, to receive your certification at the end of July 2021.
Our expert lecturers in customary Law will correct each dissertation with the greatest care and the greatest pedagogy at the end of the training session.

A brief story...
This certificate of Customary Law is the result of studies which began in 2010 within the Centre du Droit de l’entreprise and have developed since 2015 within l’Institut des usages of the School of Law of Montpellier.
L’Institut des usages has developed numerous partnerships with world-renowned universities on this subject. In particular, it organized a workshop with a dozen speakers from all over the world at the School of Law of Montpellier. This workshop aimed at taking a position on the place of customary Law in modern Law.
A strong cooperation has been established in recent years between Berkeley Law and l’Institut des usages of the School of Law of Montpellier, including the co-direction of the workshop dedicated to customary Law and the co-editing and writing of the book Customary Law Today. (Ed. Laurent MAYALI and Pierre MOUSSERON, Springer 2018.)

An expertise gathered in a book

A strong cooperation has been created between Berkeley Law and l’Institut des usages (IDU) with, in particular, the co-editing of the book “Customary Law Today” (Ed. Laurent MAYALI and Pierre MOUSSERON, Springer 2018.)
This book addresses current practices in customary Law. It includes contributions by scholars from various legal systems (the USA, France, Israel, Canada etc.), who examine the current impacts of customary Law on various aspects of private Law, constitutional Law, business Law, international Law and criminal Law. In addition, the book expands the traditional concept of the rule of Law, and argues that lawyers should not narrowly focus on statutory Law, but should instead pay more attention to the impact of practices on “real legal life.” It states that the observation of practices calls for a stronger focus on usage, customs and traditions in our legal systems – the idea being not to replace statutory Law, but to complement it with customary observations.
